1. Who we are

Makeovers by Harsha is a bridal, editorial and celebrity makeup artistry service based in Bangalore, India. It is a business of AK Ventures Inc, a partnership firm between Ankit Agarwal and Harsha Agarwal, with its principal place of business in Bangalore, Karnataka, India.

In the language of Indian data protection law we are the Data Fiduciary for the personal data described below, which simply means we decide what is collected and why, and we are accountable for it. When you give us your information you are the Data Principal.

This policy explains what we collect, why, how long we keep it, and how you can ask us to change or delete it. It applies to our website, our enquiry and booking process, our WhatsApp Business account, and our pages on Instagram and Facebook.

2. What we collect, and where it comes from

When you enquire through our website. Your name, email address, phone or WhatsApp number, and whatever you write in the message field.

When you respond to one of our advertisements. If you complete an enquiry form shown inside Instagram or Facebook, we receive the name and phone number held on your Meta profile, together with the answers you give us: roughly when your wedding is, which city it is in, and which services you are interested in. You choose whether to submit this form, and you can leave it at any point before submitting.

When you message us. The content of your messages on WhatsApp, Instagram or Facebook, along with your display name and number or handle, so that we can answer you and keep track of your booking.

When you become a client. Your wedding dates and venues, the functions you have booked us for, any skin sensitivities or allergies you tell us about so we can work safely, and a record of payments made. We ask you to tell us about skin conditions because it affects the products we use on you; you are never obliged to, and you can tell us in person instead of in writing.

Photographs and video. Images and footage taken during trials, preparation and events. This is covered separately in section 5, because it deserves to be.

When you subscribe to our newsletter. Your email address, and nothing else.

Automatically, when you browse the site. Standard technical information such as your IP address, browser type, device, and the pages you visit. This is ordinary web server and analytics data and we do not use it to identify you personally.

3. Why we use it

• To answer your enquiry, quote for your wedding and confirm whether we are available on your dates

• To plan and deliver the makeup services you have booked, safely and to the brief you have given us

• To take payment and keep the accounting records Indian tax law requires us to keep

• To keep in touch about your booking in the run-up to your wedding

• To send occasional updates about our work, but only if you have asked us to

• To show our portfolio, and only with the specific consent described in section 5

• To understand which of our posts and advertisements are working, using the aggregate reporting Instagram and Facebook give us — this tells us things like how many people in Bangalore saw a post, never who you are

We do not use your personal data to make automated decisions about you, and we do not profile you.

4. Your consent, and how to withdraw it

We rely on your consent for marketing communications and for any use of your photographs. Where we hold information because we are legally required to — tax and accounting records, for example — we keep it for as long as the law says, regardless of consent.

You can withdraw consent at any time by writing to us at the address in section 12. Withdrawing is as easy as giving it. If you withdraw consent for photographs, section 5 explains exactly what happens next.

5. Photographs of you

This is the part of our work that touches your privacy most directly, so we want to be precise about it.

We photograph and film our work. Those images may be used on our website, on Instagram and Facebook, in advertising, in printed portfolios, and when we teach. We will only ever do so with your explicit permission, asked for separately from your booking. Saying no does not change the service you receive, the price you pay, or how we treat you on the day.

If you ask us to stop using an image, we will. Write to us and we will remove it from our website and our own social media accounts, and stop using it in any future advertising or teaching material.

We will be honest about one limit: where an image has already been reshared by a photographer, a venue, a publication or another guest, we cannot always compel a third party to remove their copy. We will tell you who we shared it with so you can ask them directly, and we will support that request.

Some clients ask us to keep their wedding entirely private, and some ask us to post but not to tag them. Both are completely normal requests and we would rather you asked than assumed. If you have told us your event is private, we treat that as covering the images, the venue, the guest list and the fact that we worked with you at all.

6. Who we share information with

We share the minimum necessary, with:

• Our assistants and team members working on your event, who are told to treat your details as confidential

• Photographers, planners and venues involved in your wedding, and only where coordination requires it — usually your timings and location

• Service providers who run our tools — our website host, our email provider, and Meta, which operates WhatsApp Business, Instagram and Facebook. When you message us on WhatsApp or submit a form on Instagram, that information passes through Meta's systems and is also governed by Meta's own privacy policy

• Our accountant, for tax and bookkeeping

• Public authorities, where the law requires us to

What we never do. We do not sell your personal data. We do not rent or trade our client list. We do not upload our clients' contact details to Meta, Google or any other advertising platform to target advertisements — not at you, and not at people who resemble you.

We treat the fact that you are getting married, and everything you tell us while planning it, as confidential.

7. How long we keep it

• Enquiries that do not become bookings: up to twelve months, in case you come back to us, then deleted

• Client and booking records: for as long as Indian tax and accounting law requires us to retain them, which is generally six years from the end of the relevant financial year

• Photographs: until you ask us to stop using them, or until we no longer need them

• Newsletter subscriptions: until you unsubscribe

• WhatsApp and social media conversations: for as long as they are useful as a record of your booking, and then deleted

8. How we protect it

We keep your information on password-protected devices and accounts, we limit access to the people who need it to do their work, and we do not keep client details written down where others can see them. Our website is served over an encrypted connection.

No system is perfectly secure, and we will not pretend otherwise. If a breach occurs that affects your personal data, we will notify you and the Data Protection Board of India as required.

9. Your rights

Under the Digital Personal Data Protection Act, 2023 and the rules made under it, you have the right to:

• Know what we hold about you and who we have shared it with

• Have it corrected if it is wrong, incomplete or out of date

• Have it erased, where we are not required by law to keep it

• Raise a grievance with us, and receive an answer

• Nominate someone to exercise these rights on your behalf if you die or become incapacitated

Write to us using the details in section 12 and we will respond within thirty days. There is no charge. If you are not satisfied with our answer, you may complain to the Data Protection Board of India.

10. Children

Our services are offered to adults. We sometimes do makeup for guests under eighteen — younger sisters, cousins and bridesmaids — as part of a family booking. In those cases we take instructions and consent from a parent or guardian, and we do not photograph or publish images of anyone under eighteen without a parent or guardian agreeing in writing.

We do not knowingly collect personal data directly from children through our website or advertising.

11. Cookies, analytics and other websites

Our website uses cookies to function and to help us understand which pages people find useful. You can block or delete cookies in your browser settings; parts of the site may not work as well if you do.

We use Google Analytics to understand how our site is used — which pages people visit and how they found us. Google processes this data on our behalf and it is governed by Google’s own privacy policy.

When we run advertisements on Instagram and Facebook, we use Meta’s measurement tools to see how those advertisements perform. These tell us aggregate results — how many people saw an advertisement and how many enquired — and are also governed by Meta’s privacy policy.

Our site and our social media pages link to other websites — photographers, venues, publications. We are not responsible for how those sites handle your information, and we would encourage you to read their policies.

13. Changes to this policy

We may update this policy as our business changes or as the law does. The effective date at the top tells you which version you are reading. If we make a significant change to how we use your information, we will tell affected clients directly rather than relying on you to notice.
